Policy and Privacy

This policy explains how Orbit Elements handles information submitted through the website, pre-request form, account access workflows, and future distribution services.

1. Who We Are

Orbit Elements is operated primarily by L'Una Music Group LLC, 750 Piedmont Ave NE, Atlanta, GA 30308, United States, through the Luna X Studios ecosystem. L'Una Studios LTDA is the Brazil branch at Rua RI 12 QD 43 LT 07 CS 02, Residencial Itaipu, Goiania, Goias, Brazil. Orbit Elements may also be supported by international desks in Luxembourg and Dubai for business development, partner coordination, and regional operations.

Orbit Elements is prepared within the Luna X Studios ecosystem for music distribution, publishing-adjacent administration, promotion, monetization, music recognition, reporting, artist splits, MCN support, catalog support, and related artist or label services.

2. Scope

This Policy and Privacy applies to orbitelements.com, app.orbitelements.com, request forms, account access workflows, dashboards, support channels, catalog onboarding, release review, reporting tools, payment workflows, and related online or offline communications. It does not control the independent practices of DSPs, payment processors, social networks, music recognition providers, or linked third-party sites.

3. Information You Provide

  • Identity and contact details: full name, artist or label name, company name, email, country, profile type, representative role, and contact permission.
  • Pre-request details: main genre, release status, catalog size, total streams, Instagram link, Spotify artist link, other profile links, and message content.
  • Account details: username, password credentials, verification status, access permissions, role assignments, dashboard settings, security confirmations, and support history.
  • Catalog and release data: recordings, compositions, phonograms, videos, artwork, lyrics, artist names, titles, versions, genre, territories, release dates, UPCs, ISRCs, copyright lines, label names, credits, splits, contributors, publishers, photo credits, biographies, and promotional materials.
  • Commercial and payment data: invoices, billing status, payment method metadata, bank or payout details, tax forms, royalty statements, minimum payout status, deductions, reserves, adjustments, chargebacks, and transaction history.

4. Information Collected Automatically

When you access the site, form, or future platform, we may collect IP address, device identifiers, browser type, operating system, referral source, pages visited, session timestamps, approximate location from IP address, cookie identifiers, security logs, CAPTCHA status, authentication events, dashboard actions, upload activity, API activity, and error logs.

The website may be hosted on infrastructure such as Hostinger VPS and managed through CloudPanel. Hosting and server administration tools may process technical logs, firewall events, resource usage, request headers, IP addresses, timestamps, and error records as needed to deliver the site, secure the service, diagnose problems, and prevent abuse.

5. Information From Partners

We may receive information from DSPs, social platforms, download stores, recognition providers, MCN partners, analytics providers, payment processors, catalog partners, rights holders, fraud-prevention vendors, and Luna X Studios affiliates. This may include usage reports, royalty data, sales data, stream counts, content IDs, claims, disputes, removals, territory data, audience data, payout confirmations, tax status, and account or rights verification results.

6. How We Use Information

  • To review pre-requests, prepare early access, respond to inquiries, and qualify artists, labels, managers, and creators.
  • To create, verify, secure, support, suspend, restore, or close accounts and dashboard access.
  • To review, format, encode, validate, deliver, monetize, recognize, report, correct, or remove Content.
  • To process royalty reports, payout requests, split instructions, invoices, chargebacks, tax requirements, accounting, and audit requests.
  • To detect fraud, artificial streaming, unauthorized access, rights conflicts, duplicate catalogs, platform abuse, and security incidents.
  • To communicate service notices, support replies, launch updates, policy changes, marketing messages where permitted, and operational alerts.
  • To comply with law, enforce terms, respond to claims, cooperate with authorities, preserve evidence, and protect Orbit Elements, users, partners, and the public.

7. Legal Bases

We process information based on consent, performance of a contract, pre-contractual steps requested by you, legitimate interests in operating and securing the service, compliance with legal obligations, protection of rights, fraud prevention, and, where applicable, establishment, exercise, or defense of legal claims. These bases are intended to align with GDPR, LGPD, U.S. state privacy laws, and similar frameworks where they apply.

8. Form Delivery And Current Storage

The current coming-soon pre-request form sends submissions to [email protected]. It does not require public account creation. If database storage, dashboard access, CRM tools, or client portals are enabled later, the related records may be stored and processed according to this Policy and the Terms.

9. DSPs, Platforms, And Service Providers

To provide distribution services, Orbit Elements may share necessary Content, metadata, account details, rights details, payment data, tax data, support data, and technical data with DSPs, download stores, streaming platforms, video services, social platforms, recognition providers, fingerprinting providers, MCN partners, payment processors, hosting providers, analytics providers, customer support tools, anti-fraud vendors, professional advisors, and affiliated Luna X Studios entities.

DSPs and third-party services may process information under their own policies. Orbit Elements is not responsible for independent third-party privacy practices, store account decisions, reporting delays, platform removals, or partner policy changes.

10. Security, CAPTCHA, And Account Protection

Orbit Elements uses commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, account data, unreleased Content, metadata, royalty information, and confidential materials. Measures may include SSL/TLS, encrypted transmission, access controls, secure servers, monitoring, logging, account verification, two-factor authentication, and incident response procedures.

The pre-request form uses Cloudflare Turnstile for CAPTCHA-style verification. Users are responsible for using strong passwords, keeping credentials confidential, limiting account access, signing out on shared devices, and notifying Orbit Elements immediately about suspected unauthorized access.

11. Cookies And Tracking

The site and future platform may use essential cookies, local storage, session storage, preference cookies, security cookies, analytics, server logs, and similar technologies. These tools may remember preferences, support login, protect forms, measure traffic, diagnose errors, and improve service performance.

Google Analytics is configured for the site using Measurement ID G-3895BHBHC6 and is loaded only after the visitor accepts Analytics cookies through the cookie preferences tool. Meta Pixel may be used for Facebook and Instagram campaign measurement, retargeting, audience insights, and conversion tracking, and should load only after the visitor accepts Marketing cookies. Other non-essential advertising, social pixels, or marketing cookies should run only according to the visitor's cookie preference where consent or opt-out controls are required by law. 12. Payments, Royalties, And Tax Records

Where distribution or payout services are enabled, payment processors and financial service providers may process payment credentials, payout accounts, billing details, tax forms, invoices, transaction status, and limited financial metadata. Orbit Elements may retain royalty reports, payment history, tax documentation, reserves, chargebacks, deductions, audit records, and dispute records as needed for accounting, tax, legal, reporting, fraud prevention, and contract administration.

13. Catalog, Rights, And Confidential Materials

Unreleased recordings, compositions, release plans, financial terms, dashboard data, royalty statements, Content files, rights documentation, contracts, and business communications may be treated as confidential. Orbit Elements may share confidential materials only as needed to provide services, deliver Content, process royalties, comply with law, respond to claims, or work with authorized providers and advisors.

14. Retention

Orbit Elements retains information for as long as needed to provide the Services, operate accounts, process royalties, preserve reports, comply with law, prevent fraud, resolve disputes, support audits, administer takedowns, and enforce agreements. Account and portal data may be retained for the active relationship plus a reasonable period. Financial, tax, billing, royalty, and payout records may be retained for statutory accounting and audit periods. Non-selected pre-request or demo materials may be deleted or anonymized when no longer needed.

15. Account Closure And Deletion

You may request account closure or deletion of eligible personal information by contacting [email protected]. Some data may remain where required for royalty reporting, tax compliance, payment records, rights claims, takedowns, fraud prevention, security logs, legal obligations, backup systems, or dispute resolution. Closing an account may limit access to dashboards, reports, support tools, and future services.

16. International Transfers

Orbit Elements may support users and process information through L'Una Music Group LLC in the United States, L'Una Studios LTDA in Brazil, Luxembourg and Dubai desks, the European Economic Area, the United Kingdom, and other territories where Luna X Studios affiliates, DSPs, hosting providers, payment processors, or service partners operate. Where required, Orbit Elements uses reasonable contractual, technical, and organizational safeguards for cross-border processing.

17. Your Rights

Depending on your jurisdiction, you may have rights to request access, correction, deletion, anonymization, portability, restriction, objection, opt-out of certain sharing, consent withdrawal, and information about data sharing. Orbit Elements may verify your identity before responding. Requests may be denied or limited where data must be retained to complete transactions, preserve royalty records, comply with law, prevent fraud, protect rights, or resolve disputes.

18. Marketing Choices

Orbit Elements may send service updates, launch notices, support replies, operational emails, or marketing communications where permitted. You may opt out of marketing communications using instructions in the message or by contacting Orbit Elements. Operational, security, account, legal, payout, and support messages may still be sent where necessary for the Services.

19. Children And Minors

Orbit Elements is intended for professional artists, labels, creators, managers, and rights holders. We do not knowingly collect personal information from children under 13. Users under 18, or under the age of majority in their jurisdiction, should use the service only with a parent, guardian, label, manager, or authorized representative.

20. Business Transfers And Legal Requests

Information may be disclosed or transferred in connection with a merger, acquisition, restructuring, financing, sale of assets, affiliate transfer, bankruptcy, or similar transaction. Orbit Elements may also disclose information when required by law, subpoena, court order, regulator, tax authority, law enforcement request, rights claim, or when reasonably necessary to protect users, partners, the public, or Orbit Elements.

21. Security Incidents

If Orbit Elements becomes aware of a security incident affecting personal information, account data, or confidential materials, it will investigate, take reasonable mitigation steps, and notify affected users or authorities where required by applicable law. No internet, storage, transmission, or account system can be guaranteed fully secure.
