Anti-Fraud Policy

1. Scope

This policy applies to all use of Orbit Elements, including pre-requests, account access, catalog onboarding, metadata delivery, DSP distribution, video monetization, fingerprinting, music recognition, reporting, splits, royalty processing, support, and any future dashboard or platform feature.

It should be read together with the Terms and Conditions, Policy and Privacy, Disclaimer, and any direct agreement, service order, addendum, or partner rule that applies to a user, artist, label, release, catalog, territory, or platform.

Orbit Elements is operated primarily by L'Una Music Group LLC, with L'Una Studios LTDA as the Brazil branch and Luxembourg and Dubai desks supporting international coordination and regional operations.

2. What We Consider Fraud

Fraud is any activity that violates law, DSP requirements, Orbit Elements policies, rights-holder obligations, payment rules, or platform integrity standards in connection with content distributed, monetized, reported, fingerprinted, or managed through Orbit Elements.

• Uploading, delivering, claiming, monetizing, or fingerprinting content without all required rights, licenses, permissions, samples, publishing clearances, contributor approvals, or authority.
• Using misleading artist names, label names, artwork, titles, metadata, genre tags, performer credits, ISRCs, UPCs, territorial information, ownership claims, or release history.
• Submitting duplicate, re-recorded, public-domain, AI-generated, synthetic, low-quality, noise, loop, ringtone, spam, or bulk content in a way that violates partner rules or creates false expectations.
• Manipulating streams, downloads, views, saves, follows, playlists, likes, shares, comments, chart positions, ad engagement, fingerprinting claims, or monetization signals.
• Using bots, scripts, click farms, stream farms, paid guaranteed-stream services, incentivized plays, fake accounts, VPN farms, account sharing rings, playlist payola, or non-genuine traffic sources.
• Attempting to divert royalties, split payments, neighboring rights, Content ID revenue, master income, publishing income, or claims revenue away from legitimate rights holders.
• Evading account reviews, takedowns, territory restrictions, sanctions checks, tax or payout checks, identity checks, fraud reviews, payment holds, or prior account blocks.

3. Artificial Streaming

Artificial streaming means any stream, play, view, click, download, impression, engagement, or monetization event that does not reflect genuine user intent. This includes automated activity, deceptive activity, fraudulent activity, invalid traffic, paid manipulation, playlist schemes, click exchanges, incentivized listening, or any third-party service that promises guaranteed plays, followers, saves, playlist placement, revenue, charting, or algorithmic growth.

DSPs and social platforms use automated systems, data analysis, human review, third-party vendors, fraud markers, account signals, traffic analysis, and partner rules to identify suspicious activity. A DSP may remove streams, reverse royalties, issue penalties, reject releases, take down tracks, restrict an account, or instruct Orbit Elements to act even when a user did not personally create the invalid traffic.

4. User Responsibilities

• Only submit content you own, control, administer, or are authorized to distribute and monetize.
• Keep accurate records of licenses, samples, beats, masters, splits, contributors, label authority, artwork permissions, and publishing clearances.
• Use truthful metadata and avoid names, artwork, audio, or release strategies that confuse listeners or imitate another artist, label, brand, catalog, or rights holder.
• Do not buy streams, followers, saves, downloads, playlist placement, video views, comments, or artificial social engagement.
• Review marketing partners carefully and avoid services that guarantee traffic, revenue, charting, placement, or unrealistic growth.
• Tell Orbit Elements immediately if you notice suspicious traffic, rights conflicts, incorrect claims, compromised access, unauthorized uploads, or unusual royalty activity.

5. Monitoring And Review

Orbit Elements may review accounts, releases, content, metadata, links, royalty data, traffic patterns, payout details, rights documentation, complaints, takedown notices, DSP notices, and support history before or after distribution. We may request documentation, delay delivery, pause monetization, block payout requests, limit dashboard access, or require additional verification when risk indicators appear.

We may share relevant information with DSPs, content recognition providers, royalty processors, payment providers, anti-fraud vendors, rights holders, legal advisors, authorities, or affiliates when needed to investigate, prevent, mitigate, or resolve suspected fraud, rights abuse, platform abuse, payment abuse, or security incidents.

6. Strike Levels And Consequences

Depending on severity, history, DSP instructions, and available evidence, Orbit Elements may apply warnings, restrictions, takedowns, payment holds, account blocks, or termination. A severe event may move directly to a higher level without prior warning.

• Strike 1: user notice, review of the questioned content, possible correction request, rejection, takedown, or warning that future violations may delay royalties or restrict service access.
• Strike 2: user notice, takedown or suspension of questioned content, royalty payment delay or reserve, enhanced review, and warning that a further violation may block the account and catalog.
• Strike 3: account block, dashboard restriction, takedown of questioned content or the full catalog, termination of service access, royalty escrow, and return of illegitimate royalties to DSPs or rightful parties where applicable.

7. Royalties, Reserves, And Escrow

Royalties connected to suspected fraud, artificial streaming, rights conflicts, metadata abuse, duplicate claims, Content ID conflicts, chargebacks, DSP penalties, or legal claims may be delayed, reserved, offset, withheld, returned, or held in escrow. Legitimate royalties may be held while claims are reviewed because DSPs and rights holders may reclaim, adjust, or dispute revenue after an original report or payment cycle.

In serious or repeated cases, royalties may be held for at least twenty-four months and up to five years, or longer where required by law, DSP policy, pending claim, dispute, investigation, tax requirement, audit, payment processor rule, or court order. Illegitimate royalties may be returned to DSPs, rights holders, claimants, or other entitled parties. Users remain responsible for penalties, reversals, claims, investigation costs, legal costs, payment charges, and partner fees caused by their content, account activity, representatives, contractors, or marketing providers.

8. Takedowns And Account Blocks

Orbit Elements may submit takedowns, block new releases, disable monetization, restrict territories, suspend dashboard access, pause support actions, remove fingerprinting claims, reject assets, disable payout requests, or terminate accounts when fraud is suspected, confirmed, reported by a DSP, required by a partner, or necessary to protect artists, labels, creators, DSPs, rights holders, and Orbit Elements.

If only part of a catalog appears connected to fraud or rights abuse, Orbit Elements may still review or remove the full catalog where patterns, linked accounts, repeated violations, rights uncertainty, partner requirements, or platform risk make a broader response necessary.

9. Review Requests

A user may contact Orbit Elements at [email protected] to request a review of a fraud notice, content rejection, takedown, payment hold, or account restriction. For account access or technical issues connected to a restriction, contact [email protected]. The request should include the artist or label name, account email, release title, UPC or ISRCs, affected platforms, marketing sources, rights documentation, licenses, promotional invoices, campaign details, traffic screenshots, and any evidence showing that the activity was legitimate.

Submitting a review request does not guarantee reinstatement, payout release, delivery approval, or removal of a DSP penalty. Orbit Elements may uphold, modify, or reverse an action based on the available evidence, DSP feedback, legal requirements, partner instructions, and platform integrity risk.

10. Updates

Orbit Elements may update this Anti-Fraud Policy as DSP rules, fraud methods, royalty models, account-access controls, fingerprinting systems, and industry standards evolve. Continued use of Orbit Elements after an update means the user accepts the updated policy.
